Marketplace Policy

1. Introduction
This Marketplace Policy (the "Policy") governs the use of the Ghar Se marketplace platform, which connects buyers and sellers for the purchase and sale of goods and services. Ghar Se Technologies ("Ghar Se," "we," "us," or "our") acts as an intermediary platform and is not a party to any transaction between buyers and sellers unless expressly stated otherwise. By using the marketplace, both buyers and sellers agree to be bound by this Policy.
2. Platform Role
Ghar Se is a technology platform that facilitates transactions between independent buyers and sellers. We do not:
- Own, produce, sell, or resell any products listed on the marketplace.
- Take title to or ownership of any products listed for sale.
- Act as an agent, partner, or joint venture partner of any seller.
- Warrant the quality, safety, or legality of any products listed.
Our role is limited to providing the digital infrastructure that enables buyers and sellers to connect, communicate, and transact.
3. Seller Responsibilities
All sellers registered on the Ghar Se marketplace agree to the following responsibilities:
3.1 Product Quality and Descriptions
- Sellers are solely responsible for the accuracy, completeness, and truthfulness of all product descriptions, images, pricing, and specifications listed on the marketplace.
- Products must match their descriptions in every material respect. Misrepresentation of products is strictly prohibited and will result in immediate account suspension.
- Sellers must ensure that all products meet applicable quality standards and safety regulations in Pakistan.
3.2 Delivery and Fulfillment
- Sellers are responsible for timely delivery of products as per the estimated delivery times displayed on the platform.
- Sellers must provide accurate tracking information where applicable.
- Failure to deliver within the promised timeframe may result in order cancellation and refund to the buyer at the seller's expense.
- Sellers must have adequate inventory to fulfill orders and must promptly remove listings for out-of-stock items.
3.3 Customer Service
- Sellers are expected to respond to buyer inquiries within 24 hours.
- Sellers must handle returns, exchanges, and refunds in accordance with the Ghar Se Refund and Cancellation Policy.
- Sellers must maintain professional and courteous communication with buyers at all times.
4. Buyer Responsibilities
All buyers using the Ghar Se marketplace agree to the following responsibilities:
- Provide accurate and complete delivery information, including full name, address, phone number, and any special instructions.
- Ensure that someone is available to receive the delivery at the specified time and address.
- Pay for orders in a timely manner using the available payment methods on the platform.
- Inspect products upon delivery and report any issues within 48 hours.
- Not abuse the return or refund policies through fraudulent claims or habitual misuse.
- Communicate respectfully with sellers and Ghar Se support staff.
5. Prohibited Items
The following items and categories are strictly prohibited from being listed or sold on the Ghar Se marketplace:
- Illegal drugs, narcotics, and controlled substances.
- Weapons, firearms, ammunition, explosives, and hazardous materials.
- Stolen goods, counterfeit items, and replicas.
- Adult content, pornography, and sexually explicit materials.
- Tobacco, alcohol, and related products (unless explicitly permitted under applicable law and with appropriate licensing).
- Live animals, endangered species, and animal products covered under CITES.
- Human remains, organs, and body parts.
- Prescription medications and medical devices without valid licensing.
- Currency, financial instruments, and virtual currencies.
- Gambling-related items and services.
- Any item that violates Pakistani law or any applicable international law.
Ghar Se reserves the right to remove any listing that violates this policy without prior notice. Sellers listing prohibited items will have their accounts immediately suspended and may be reported to relevant authorities.
6. Commission and Fee Structure
Ghar Se charges a commission on each transaction facilitated through the marketplace:
- Standard Commission: A percentage of the total order value is charged as a platform fee. The exact percentage varies by product category and is disclosed to sellers at the time of registration and listing.
- Payment Processing Fee: Additional fees may apply for payment processing, as charged by our third-party payment partners.
- Promotional Fees: Sellers may opt into promotional campaigns or featured listings for additional fees, which will be clearly communicated before opt-in.
- No Listing Fee: There is no fee to list products on the Ghar Se marketplace. Commission is charged only upon successful sale.
Ghar Se reserves the right to modify the commission structure at any time with 14 days' notice to sellers.
7. Dispute Resolution
In the event of a dispute between a buyer and a seller:
- Direct Resolution: Buyers and sellers are encouraged to resolve disputes directly through the platform's messaging system.
- Mediation by Ghar Se: If direct resolution fails, either party may escalate the dispute to Ghar Se for mediation. We will review the case based on available evidence, including order details, communication logs, and any supporting documentation.
- Ghar Se Decision: Our decision in mediated disputes is final and binding on the platform. We reserve the right to issue partial or full refunds, chargebacks, or credits at our sole discretion.
- Legal Action: Nothing in this Policy prevents either party from seeking legal remedies through appropriate courts of law in Pakistan.
Note: Ghar Se's role in dispute resolution is limited to facilitating communication and making platform-level decisions. We are not a court or arbitral tribunal and cannot adjudicate legal claims.
8. Seller Performance Standards
Ghar Se maintains performance standards to ensure a high-quality experience for all users:
- Order Fulfillment Rate: Sellers must maintain a minimum 95% order fulfillment rate (orders shipped vs. orders received).
- On-Time Delivery Rate: Sellers must maintain a minimum 90% on-time delivery rate.
- Customer Rating: Sellers must maintain a minimum average rating of 4.0 out of 5.0 stars.
- Response Time: Sellers must respond to customer inquiries within 24 hours, maintaining a response rate of at least 90%.
- Dispute Rate: Sellers with a dispute rate exceeding 5% of total orders may be subject to review and potential suspension.
Sellers who consistently fail to meet these standards may have their listings deprioritized, their accounts suspended, or their seller privileges revoked.
9. Marketplace Content and Intellectual Property
- Sellers warrant that they own or have the necessary licenses to use all content (images, descriptions, trademarks) they upload to the marketplace.
- Sellers grant Ghar Se a non-exclusive, worldwide, royalty-free license to use, display, and distribute their listings for the purpose of operating and promoting the marketplace.
- Ghar Se reserves the right to remove any content that infringes on third-party intellectual property rights.
10. Policy Violations and Enforcement
- Violation of any provision of this Policy may result in warning, listing removal, account suspension, or permanent ban from the marketplace.
- Repeat violations will result in escalating enforcement actions, up to and including permanent account closure.
- Ghar Se reserves the right to withhold payments and commissions due to sellers who are under investigation for policy violations, pending resolution of the matter.
- Fraudulent activity, including but not limited to fake orders, fake reviews, and price manipulation, will result in immediate and permanent account termination.
11. Modifications to Policy
Ghar Se reserves the right to update or modify this Marketplace Policy at any time. Sellers and buyers will be notified of material changes via email or through the platform. Continued use of the marketplace after changes take effect constitutes acceptance of the modified policy.
